Tribe appeals judge's ruling in pipeline protest, seeks new injunction

"And we're going to make this stand for all water and all life", Mitchell said at the start of the event, drawing cheers.

Boasberg's ruling said that "this Court does not lightly countenance any depredation of lands that hold significance to the Standing Rock Sioux" and that, given the federal government's history with the tribe, "the Court scrutinizes the permitting process here with particular care".

Almost 40 people have been arrested since the protest began in April, including tribal chairman Dave Archambault II, though none stemmed from Saturday's confrontation between protesters and construction workers. Energy Transfer Partners denied the allegations.

"There is a high likelihood of additional sites in this area that the tribes should be given an opportunity to survey for, and seek to protect before they are destroyed", wrote Hasselman, an attorney for environmental law firm Earthjustice.

Morton County authorities also have charged Cody Charles Hall, 39, Eagle Butte, S.D., with trespassing after identifying him from video and photos viewed by investigators, said Donnell Preskey, spokeswoman for the Morton County Sheriff's Office.

"The Army will not authorize constructing the Dakota Access pipeline on Corps land bordering or under Lake Oahe until it can determine whether it will need to reconsider any of its previous decisions" on the site, authorities said in a statement.

Washington's intervention in the case came late Friday, in a joint statement that three federal departments issued shortly after a district court rejected the local Sioux tribe's request for an injunction.

Like the Standing Rock Sioux, Maine's tribes have had conflicts with government and industry. "Despite the federal government's legal trust responsibility to ensure federally permitted projects do not threaten historically or culturally significant tribal places, the trust lands of tribal nations, or the waters that run through them, the Standing Rock Sioux were never consulted about the DAPL, which will run less than a mile from their reservation".

After Judge Boasberg said in his ruling that the U.S. Army Corps of Engineers decision to fast-track the pipeline project was not illegal, tribal leaders quickly filed a notice of appeal.

In a joint statement, the US Justice and Interior Departments and the Army acknowledged "important issues raised by the Standing Rock Sioux Tribe and other tribal nations".

The Corps of Engineers has declined to comment, citing the pending litigation.

The 1,172-mile project will carry almost a half-million barrels of crude oil daily from North Dakotas oil fields through South Dakota and Iowa to an existing pipeline in Patoka, Illinois. "In trucks and trains or in pipelines?"

"They can not guarantee that it (the pipeline) will not break or burst".

Monroe said when they used dogs to attack American people on American soil it showed that America still has a long way to go.

But protesters disputed that account, KFYR reported. Over Labor Day weekend, violence flared between private security and protesters when a few protesters were bitten by dogs, and even more were pepper sprayed.
