Federal judge blocks Indiana abortion ultrasound measure

A federal judge has prohibited IN from enforcing a state-mandated ultrasound at least eighteen hours prior to an abortion procedure.

Planned Parenthood of IN and Kentucky and the American Civil Liberties Union of IN had sued the state last July, contending the mandate was unconstitutional and would prevent some women from getting abortions.

But on Friday, women's rights advocates found reason to hope: U.S. District Judge Tanya Walton Pratt's ruling (pdf) found that the requirement that women have an ultrasound is likely unconstitutional, and creates an "undue burden" particularly for low-income women.

Prior to the 2016 IN anti-abortion law, women could get an ultrasound IN the same visit as their abortion.

A federal judge has blocked an IN law that would have required pregnant women to undergo an ultrasound at least 18 hours prior to an abortion. "There have been lots of states to take away Title X funding to Planned Parenthood, and the effects have been awful", Lynn said.

Previously, the state of IN required doctors to perform an ultrasound prior to an abortion but did not set a time requirement associated with the procedure.

While the radical abortion lobby and many on the political left argue that the Hyde Amendment prevents tax-payer money from going towards abortions, this is simply a deception tactic. Four states have outright mandates for abortion providers to administer ultrasounds and present the results to their patients seeking abortions.

Planned Parenthood sued the commissioner of the Indiana State Department of Health as well as several county prosecutors a year ago, specifically targeting the ultrasound mandate in its complaint.

Cockrum says Indiana's mandate created scheduling and travel burdens that threatened some women's ability to legally obtain a medical or surgical abortion. According to a 2016 Christian Science Monitor article, at least 13 states have passed laws restricting Title X funds to abortion providers since 2011.

Planned Parenthood's Kansas City center has offered medication-induced abortions and said it would resume doing so if Sachs deemed the Missouri regulations in question unconstitutional, Planned Parenthood attorney Melissa Cohen told the judge last month. The same federal judge also issued injunctions stopping those requirements from being put into effect.

Ken Falk, legal director of the ACLU of IN, which represented Planned Parenthood IN district court, said IN a Monday news conference that Planned Parenthood does not have sufficient staff or funds to extend its ultrasound services to additional health centers around the state.

Former Governor Mike Pence signed the bill into law last July.

"This creates a substantial obstacle that disproportionately affects low-income women", Ken Falk, legal director for the American Civil Liberties Union of IN, said IN Federal Court last November.
