Trump Draws Laughs With 7-Word Joke About The Ninth Circuit Court

U.S. District Judge William Orrick ruled on Tuesday that the executive order was likely unconstitutional, partly because of its ban on federal funding that "bears no meaningful relationship to immigration enforcement".

"This is why we have courts", San Francisco City Attorney Dennis Herrera said.

Asked about Orrick's ruling Wednesday, Trump averred that he is "never surprised by the 9th Circuit", reinforcing an early morning tweet in which he declared that it "has a bad record of being overturned (close to 80 percent)". Trump is accusing political opponents of "judge shopping" - more commonly called "forum shopping", a colloquial term for the practice of searching for a judge who will grant a favorable outcome - in order to get cases heard by the 9th Circuit.

"Federal funding that bears no meaningful relationship to immigration enforcement can not be threatened merely because a jurisdiction chooses an immigration enforcement strategy of which the president disapproves", Orrick said.

The White House said it would pursue all legal options, but lamented that the incident was "yet one more example of egregious overreach by a single, unelected district judge".

In his 49-page opinion Tuesday, Orrick sided with Santa Clara County and the city and county of San Francisco in their challenge to Trump's sanctuary cities executive order. "The rest of the order is broader still, addressing all federal funding", Orrick said.

The government hasn't cut off any money yet or declared any communities sanctuary cities.

In February, he called the federal judge in Seattle who ruled against his first travel ban a "so-called judge".

The White House described Judge Orrick's decision as a gift to the criminal gangs and cartels active in the U.S., adding that it empowered those involved in human and sex trafficking and put thousands of innocent lives at risk.

Orrick said Trump can not set new conditions on spending approved by Congress.

The administration has often criticized the 9th U.S. Circuit Court of Appeals.

Even if the president could do so, those conditions would have to be clearly related to the funds at issue and not coercive, as the executive order appeared to be, Orrick said.

"The Trump administration can say all it wants, but we're beginning to see all those words of Donald Trump the candidate unravel as he tries to exercise his power as Donald Trump the president", Becerra said. "Federal funding that bears no meaningful relationship to immigration enforcement can not be threatened merely because a jurisdiction chooses an immigration enforcement strategy of which the President disapproves".
