Suspect in crash that hurt boy had been deported 15 times

That's how federal agents describe the hit-and-run driver who struck 6-year-old Lennox Lake in the back of his parents' Honda Accord late Saturday night as they drove home from Disneyland.

His bail was set at $230,000.

Lake's dad choked up as he described how his son anxious about his parents immediately after police believe 38-year-old Constantino Banda-Acosta T-boned them.

Despite the pick-up from these anti-immigration and white supremacist groups, San Diego County Deputy District Attorney Christopher Chandler told a local news station on Wednesday that Banda-Acosta's immigration status would not affect the case.

He is also in trouble with Immigration and Customs Enforcement (ICE), once again.

The victims' Honda Accord sustained the heaviest damage on the driver and rear passenger's side, where Lennox Lake was riding in his vehicle seat, relatives told the San Diego Union-Tribune.

Chula Vista police said they arrested Banda-Acosta twice on charges of domestic violence against his wife, on April 9, 2006, and this year on January 9.

He told NBC 7, he works with some clients who have been deported half a dozen times and some manage to come back to the USA illegally, in less than a week. "We can't imagine our life without him", the boy's father said. "I feel like it's a broken system".

Lake recalled that the family left Disneyland rather early on Saturday to get home, so they could spend Sunday with Lennox and their other two sons, ages 14 and 16. His wife, Ingrid, crawled out of the front passenger seat and rushed to aid Lennox, who was unconscious, not breathing and bleeding from his nostrils, ears and head, his grandmother said.

Banda-Acosta's Chevrolet Silverado hit the side where Lennox was sitting in his auto seat, leaving him unconscious, bleeding from his nostrils and breathless, his grandmother Cheryl Lake explained. "His scalp has a laceration on it that required six stitches", Lake, who struggled to hold back tears, told KGTV. But the boy had suffered deep fractures to his skull along with a broken nose and scrapes. "He can't open one of his eyes, so he's kind of scared about why he can't see". "[I hope] justice does their job and things work out the right way", said Lake.

A GoFundMe page has been set up to help pay for the child's hospital expenses.

"We treat everyone fairly - whether they're here legally or not", he said.
