House panel will subpoena Flynn in Russian Federation probe

The leaders of the Senate intelligence committee said Tuesday they had subpoenaed two of former National Security Adviser Michael Flynn's businesses as part of the ongoing probe into Russian activity during last year's presidential campaign.

The committee's action comes a day after Flynn's lawyer notified the committee that his client will invoke his Fifth Amendment protection against self-incrimination and not comply with the committee's subpoena seeking documents related to its investigation. "The Fifth Amendment privilege does not apply to business entities, period", he said, adding that both Supreme Court and District of Columbia Circuit Court rulings would weigh on the committee's side. The Senate Intelligence Committee announced it has subpoenaed two companies owned by Flynn.

In his remarks, Burr said that the committee would still like to hear from Flynn and to review his business documents related to the Russian Federation investigation.

The Senate Intelligence Committee originally subpoenaed Flynn's personal documents on May 10, after he declined to cooperate with its April 28 request in relation to the panel's investigation of Russian interference in the 2016 election and possible ties to Trump associates. "Otherwise all options should be on table", Rubio, who sits on the intelligence committee, wrote on Twitter. "At the end of that option is a contempt charge".

"If there in fact is not a response, we will seek advice on how to proceed forward", Burr said.

Both of the committees want Flynn to give information about Trump's links with Russian Federation and any knowledge about any interference by Russian Federation in the U.S. election.

"That's not our preference today", Burr told reporters.

"We'd like to hear from Gen. Flynn", he said. "We need to use whatever compulsory mechanism necessary to get the information he possesses ... the Fifth Amendment right not to provide materials or documents is limited", he added.

"It's a decision that the committee has made that we're not at the appropriate avenue in a potential criminal investigation".

Flynn was sacked from the White House in February after failing to reveal information about his discussions with Russia's ambassador to the United States, Sergei Kislyak, and also misleading Mike Pence.

Also Wednesday, former Trump campaign foreign policy adviser Carter Page told The Associated Press that he will testify next month before the House intelligence committee.

Before the April request, Flynn said through a statement from his lawyer that he wouldn't submit himself to questioning from the committee "without assurances against unfair prosecution".
