Defense Secretary Mattis did not 'freeze' Trump's trans military ban

He said he would create a panel of experts that would include members of the departments of Defence and Homeland Security "to provide advice and recommendations" on the implementation of the measure, TIME magazine reported. But on August 23, the White House said it would send guidelines to the Pentagon on implementing the ban and allow for the removal of current transgender soldiers. Basically, in this statement, he's doing exactly what he was told to do by the White House, which is to wait until the panel files its report, then issue his own guidance based on that next February.

"After consultation with my Generals and military experts, please be advised that the United States Government will not accept or allow Transgender individuals to serve in any capacity in the U.S. Military", Trump tweeted out on July 26. This plan will advise "as to what steps are appropriate and consistent with military effectiveness and lethality, budgetary constraints, and applicable law" regarding transgender troops in the military.

That current policy was implemented by former President Barack Obama a year ago.

A highly cited RAND Corporation study previously concluded that transgender troops bring a negligible effect to the US military in both combat readiness and military spending. That's one reason it benefits the military to keep transgender individuals who have gone through full military training and are already serving in the US Armed Forces.

But, as part of that implementation plan, officials need to determine how to address transgender troops now serving in the military.

Opponents of Trump's transgender service ban argue that it was a politically calculated move to discriminate against transgender individuals and that the President did not have any military basis the decision. A statement from National Center for Lesbian Rights lawyer Shannon Minter circulated, which began with the line, "The USA Today story is grossly misleading". Until the Secretary has made that determination, no action may be taken against such individuals under the policy set forth in section 1 (b) of this memorandum. That ban will go into effect in about 7 months, on March 23. The notion that there is any good faith "study" being conducted is a blatant pretext for unmitigated, vicious, baseless discrimination.

"The Trump administration has provided no evidence that this pronouncement was based on an analysis of the actual cost and disruption allegedly caused by allowing men and women who are transgender to serve openly", ACLU lawyers said.
