Why Kenya's Supreme Court threw out Kenyatta's presidential victory

The Kenyan Supreme Court on Friday declared the country's presidential elections "null and void" and ordered the election to be reheld within 60 days.

"The election was not conducted within the dictates of the constitution", Kenya Supreme Court Chief Justice David Maraga said, announcing the court's decision.

Kenya has made history, as it has become the first country in Africa to annul a presidential election.

But this country remains riven by tribal rivalries that come to a head at election time, largely between Kenyatta's Kikuyu tribe and Odinga's fellow Luos. "We are ready but can not repeat the election with this commission".

Six judges ruled in favour of the petition filed by opposition leader Raila Odinga.

"I personally disagree with the ruling that has been made today but I respect it".

A lawyer who works for Kenyatta, Ahmednasir Abdullahi, denounced the Supreme Court's decision as "very political", but acknowledged that by law the court had to be respected. The run up to the vote was marked by court challenges over voting procedures and fears over the effectiveness and credibility of the IEBC, whose management was only appointed in January.

While in Austria, court overturned presidential election in the country after it was marked by a lot of irregularities.

Speaking at a press conference he said: "The commission intends to make internal changes to our personnel.as we prepare for the fresh presidential election in 60 days". "It's something that I did not expect but this will not change our political stance on Jubilee, and even if the opposition have carried the day in court, its (President) Kenyatta who will have the last laugh when the election is done because we will once again turn out in large numbers and vote for him,".

The decision was met with joy in the streets of the capital, Nairobi, where armed police barricaded streets leading to the Supreme Court on Friday.

A row over the 2007 poll, which Odinga challenged after being declared loser, was followed by weeks of ethnic bloodshed that killed more than 1200 people.

ODM National Treasurer Mr Timothy Bosire said opposition has been denied victory for too long and it is clear that Jubilee rigged the elections. "Let us be people of peace", he said in a speech.

Three of Kenya's presidents since independence from Britain in 1963 have been Kikuyu and one has been from the Kalenjin tribe.

Trading on Kenya's stock exchange, the Nairobi Securities Exchange, was briefly suspended following the ruling but has since resumed.

Kenya's election commission had admitted that there had been a hacking attempt on its computer system but maintained it was unsuccessful.
