Trump Says Cohen Tape Proves 'Your Favorite President' Did Nothing Wrong

Trump had initially said publicly that he believed his longtime fixer would remain loyal to him, but Cohen has increasingly suggested he's preparing to cooperate with the feds as he grows more and more isolated from his former boss.

The New York Times reports that on the recording Mr Trump and Mr Cohen discuss paying Karen McDougal, who says she had an affair with Mr Trump. Giuliani confirmed the existence of the recordings, which are in the possession of the Federal Bureau of Investigation, and told reporters Friday that the tapes would be exculpatory for Trump.

As for the legality of recording a private conversation, the content of what is on the alleged tape matters. The source with knowledge also said Cohen's recording of the tape was not illegal, as NY is a one-party consent state for recordings. Giuliani said the recording is short-less than two minutes, according to another source - and was simply a professional exchange between a client and his lawyer.

Giuliani added that Cohen was speaking with Trump to tell him that information and Cohen recommended Trump buy the rights from AMI.

In a tweet on Saturday, a lawyer for Cohen, Lanny Davis called Trump and Giuliani's strategy "flawed" and the president's Twitter statement against Cohen "false".

The woman has claimed she had an affair with Trump.

Mitchell Epner, an attorney at Rottenberg Lipman Rich who was previously an assistant USA attorney for the District of New Jersey, told Business Insider that Cohen could have made the recording either "for his own protection" or to ensure he got repaid for an expenditure he thought could have been agreed to in the conversation. "Any attempt at spin can not change what is on the tape", Davis said in a statement on Friday.

Cohen's recording adds to questions about whether Trump tried to quash damaging stories before the election.

The recording was first reported Friday by The New York Times.

"Obviously, there is an ongoing investigation, and we are sensitive to that", Davis said.

The FBI is also investigating Cohen's payment of $130,000 to adult film star Stormy Daniels in the weeks leading up to the election in exchange for silence about an alleged one-time encounter with Trump. As part of the deal, McDougal signed a nondisclosure agreement that prevented her from revealing the affair.

In her lawsuit against AMI, McDougal said she was happy when AMI bought her story in August 2016 but did not publish it, because she was not anxious for publicity before the campaign.
