Mueller's office denies Federal Bureau of Investigation tricked Flynn

Flynn's sentencing has been postponed four times over the past year.

Federal prosecutors Friday rejected former National Security Adviser Michael Flynn's suggestion that he should have been warned of the consequences of lying to the FBI, telling a judge Flynn's false statements were "voluntary and intentional".

Special Counsel Robert Mueller, who is investigating Russian interference in the 2016 US presidential election, cited Flynn's senior posts in government in pushing back against Flynn's assertion that the lack of a warning should be a mitigating factor in his sentencing on Tuesday.

But the filing said that the agents were anxious that warning Flynn "might adversely affect the rapport". Flynn's lawyers joined in that request, but they also used their 178-page submission to underscore their client's 33-year military career, cooperation and "genuine contrition" while criticizing the agents' conduct.

If it indeed proves to be the case that Flynn and his legal team received these exculpatory documents only after pleading guilty because Judge Sullivan ordered Mueller's team to turn over anything they'd been withholding, not only is this case going to be tossed, the federal prosecutors involved in it are going to face legal discipline for their behavior. "Those misimpressions do not change the fact-as the defendant has admitted in sworn testimony to this District Court-that he was indeed lying, and knowingly made false statements to FBI agents in a national security investigation".

The claim picked up steam after Republicans on the House intelligence committee issued a report this year that said Comey, in a private briefing, said that the agents who interviewed Flynn "discerned no physical indications of deception" and saw "nothing that indicated to them that he knew he was lying to them".

Prosecutors also included a partially redacted summary of an interview with former Federal Bureau of Investigation agent Peter Strzok, one of the agents who interviewed Flynn, who described his relaxed demeanor. According to the memo, after Flynn gave false statements about knowing the Russian Ambassador the agents gave him multiple chances to correct his statements.

In exchange for that assistance, the special counsel asked U.S. District Judge Emmet Sullivan to spare Flynn, a three-time Bronze Star recipient, from any prison time. "That notwithstanding, they concluded he was lying". Both McCabe and Strzok were fired, just as Flynn was forced out of the White House under circumstances that remain murky.

And the only notes directly related to the January 2017 interview with Flynn was a summary written by McCabe, who seemed to have convinced Flynn the objective of the meeting was to discuss leaks to the media about his calls with Ambassador Kislyak.

"To come in and say 'what did you talk to Sergey Kislyak about, ' and then you lie about it, that isn't entrapment".

Flynn was dismissed from the Trump administration less than one month after he started.

The meeting with Flynn in the White House was set up by then-FBI Deputy Director Andy McCabe, who served as the agency's acting director after James Comey was sacked by Trump as FBI director in May 2017.

Flynn, however, agreed to be interviewed alone.

Former federal prosecutor Joe diGenova blasted the federal government for what he called "one of the most disgraceful events in American criminal justice". Some already are demanding that President Trump pardon him and are outraged at the mishandling of his case.
