Supremes block Louisiana law requiring backup for abortionists

In that case, the high court voted 5-3 to rule that portions of a Texas law regulating abortion doctors and clinics constitute an "undue burden" on a woman's right to abort her child and are therefore unconstitutional.

Louisiana's Unsafe Abortion Protection Act requires a doctor to have admitting privileges at a hospital within 30 miles of the abortion clinic where a procedure is performed. Anthony List Marjorie Dannenfelser, adding that the law protects women from the "abortion lobby, which repeatedly puts profit over health and safety standards". The case was the first abortion-related decision that Justice Brett Kavanaugh has decided on since joining the court previous year.

The U.S. Court of Appeals for the Fifth Circuit reversed it, holding in a 2-1 decision that this Louisiana law was different than the Texas law invalidated in WWH and that this law does not run afoul of Supreme Court precedent. Kavanaugh said the Supreme Court should wait and see how the law plays out in the real world before granting such an injunction.

In cases on what has been called the court's "shadow docket", those in the majority typically do not provide detailed reasoning for why they granted or denied the requests.

The Center for Reproductive Rights, an abortion rights group that represents the challengers, said the law could lead to the closure of two of the three abortion clinics operating in Louisiana, a state of more than 4.6 million people.

According to the newest Supreme Court justice, there are now four doctors in Louisiana that perform abortions at the state's three abortions clinics.

The order is only temporary, as the plaintiffs in the case file an appeal to the Supreme Court to hear the merits of their challenge. The conservative states that would outlaw abortion if Roe fell will then simply pass TRAP laws so onerous that almost every abortion provider in those states will be forced out of business. His conservative views on abortion, said to have been shown when he was a lower court judge, were a major factor in opposition to his nomination to the Court a year ago by President Trump. The law has been blocked since litigation began, so issuing the stay effectively changes nothing in terms of the immediate legal landscape.

SHAPIRO: When, not if, an abortion challenge makes its way to the Supreme Court. Plaintiffs, however, have argued that two of the state's three clinics would close if the law took effect. Had Kavanaugh written that Louisiana "pinky promised to not violate the law", his reasoning would have been no less absurd.

The justices still may hear the case.

Benjamin Clapper of Louisiana Right to Life said he was not concerned by Roberts' break with the other conservative justices, suggesting the chief justice might eventually vote to let the law take effect.

The Supreme Court is the final defense against risky and unconstitutional attacks on basic rights and freedoms that affect the most important parts of our lives. Rare is the case that presents a statute identical to one that's already been ruled unconstitutional.

"The new makeup of the Supreme Court indicated that it was likely it would have gone through, which would have had devastating consequences", she said.
