Trump Will 'Protect' Emergency Declaration If Congress Disapproves, Miller Says

In June, 2018, NPR reported that at least five governors, including two Republicans, had decided against sending their National Guard troops to the U.S. -Mexico border because of the Trump administration's inhumane practice of ripping immigrant children away from their parents.

Trump signed the declaration to justify diverting billions of federal dollars from military construction and other purposes after Congress approved only a fraction of the money he had demanded.

In his announcement, Trump said he is also expecting to be sued over the declaration and Speaker of the House Nancy Pelosi has expressed that Democrats may take legal action.

Becerra cited Trump's own comment on Friday that he "didn't need to do this" as evidence that the emergency declaration is legally vulnerable.

"I think there are plenty of votes in the House to make sure that there's no override of the president's veto", he said.

Congress is unlikely to muster a veto-proof majority to vote down Trump's emergency move.

Duckworth admitted that it's unclear if Democrats would be able to get the two-thirds majority, calling a veto override a "different story". "But frankly, I think there's enough people in the Senate who are concerned that what he's doing is robbing from the military". "We can't second-guess it", said John Eastman, a professor of constitutional law at the Chapman University School of Law.

After Miller and Wallace went back and forth on the details of border policy, Miller insisted that "the bottom line is this: You can not conceive of a nation without a strong secure border".

"Can you point to a single incident, even one, where the president asked Congress for money, Congress refused to give him that money, and the president then invoked national emergency powers to get the money?" asked Wallace.

Trump aides acknowledge that Trump can not meet his pledge to build the wall by the time voters decide whether to grant him another term next year, but insist his base will remain by his side as long as he is not perceived to have given up the fight on the barrier. I didn't need to do this. "And I don't have to do it for the election". In addition, building the wall will destroy remaining trade relations with Mexico, steepen an already greatly flawed immigration system and greatly impact Mexican cities whose economies rely heavily on tourism from the U.S.

On CNN, Senator Sherrod Brown of OH, a potential Democratic candidate for president in 2020, put it another way, referring to a familiar Trump promise from the campaign trail last time out.

"He's going to protect his national emergency declaration - guaranteed". "That represented an astonishing betrayal of the American people", he said, essentially accusing Trump's Republican predecessor of treason.

Miller assailed former Republican President George W. Bush for an "astonishing betrayal" of the US almost two decades ago when four times as many illegal migrants were entering the United States as now.

"In this case, there's a lot of questions as to whether or not this constitutes a national emergency".

"It's become clear that this is not an emergency, not only because no one believes it is, but because Donald Trump himself has said it's not", Becerra said. "So it's going to be settled in court", Jordan said Sunday on ABC News "This Week". "But I'd rather do it much faster".

A resolution of disapproval would let Congress overturn Trump's declaration and would likely pass in the Democratically controlled House of Representatives.
